General Terms & Conditions
By using this website, users agree to be bound by these Terms & Conditions and agree to abide by the obligations contained herein. Changes to these Terms & Conditions may be made from time to time and will be posted online. Continued use of the site constitutes users’ acceptance of these changes. If you do not accept these Terms & Conditions, you should cease using this site immediately.
1. Site Access
There are three levels of access to the site.
- General browsers users, who will not need to register to view site contents.
- Content contributors, who will be approved to upload news sections following registration.
Membership is restricted and at the discretion of those users approved by the Website Moderator/ Project Co-ordinator.
- Website Moderator
artsandhealth.ie is an independent, national arts and health website developed by the Waterford Healing Arts Trust (WHAT) and Create, the national development agency for collaborative arts in social and community contexts and supported by the Arts Council.
artsandhealth.ie will collect data when you register as a member. Both WHAT and Create will have shared use of this data. The data will be used to administer membership and the services provided by the site now or in the future. Data may be disclosed to the police, regulatory bodies or legal advisers in connection with any alleged criminal offence or suspected breach of the site’s Terms & Conditions by you or otherwise where required by law.
artsandhealth.ie will not pass or sell your data to third persons for any other purpose other than those set out above.
Transfer of data: This site is accessible via the internet and therefore I understand that the data is viewable by those accessing the internet outside of Ireland.
2. User Warrantees
I agree that all information and details provided by me to artsandhealth.ie is accurate, true and up to date in all respects and at all times. I will at all times comply with these Terms & Conditions.
In addition, I agree to indemnify artsandhealth.ie, WHAT and Create from any claim, expenses, costs or damages (including any legal fees in relation to the same) made by any third party in respect of any matter in relation to or arising from my use and/or membership of the site arising from any breach or suspected breach of these Terms & Conditions by me or my violation of any law or the rights of any third party.
I agree to indemnify and keep indemnified artsandhealth.ie, WHAT and Create from and against all claims, damages, expenses, costs and liabilities arising in any manner from my entry to and use of the site other than in accordance with these Terms & Conditions.
The use of this site is only for lawful purposes, in a manner which does not improperly infringe the rights of, or restrict or inhibit the use and enjoyment of, this site by any third party. Such restriction or inhibition includes, but is not limited to, conduct which is defamatory, or which may harass, cause distress to any person or the transmission of any obscene, racist or offensive content or interruption of the normal flow of dialogue within this site. WHAT and Create may exercise control over the content of the website within the terms of this agreement, removing certain content or disable access to content as it sees fit or for any other reason artsandhealth.ie decides.
Where content that is user generated is posted onto the site and uploaded under a Creative Commons License or other shareware, authors hereby consent to artsandhealth.ie editing such content in any way it deems appropriate for whatever reason. In all other respects the Creative Commons License remains unaltered.
4. User Conduct on the Service
The following violations are grounds for immediate suspension of service that will result in termination of membership accounts(s):
The posting and transmitting of any unlawful, threatening, abusive, defamatory, obscene material onto the site, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any local, state, national or international law.
The posting or transmitting of any information or software which contains harmful components included but not limited to: software viruses of any kind, self-replicating programs that might cause harmful interference for User’s and/or Company’s hardware and/or software. The uploading, posting, publishing, transmitting, reproducing, or distributing in any way of information, software or other material obtained through the Service which is protected by copyright, or any other proprietary right, or derivative works with respect thereto, without obtaining permission of the copyright owner or the owner of any proprietary right.
Copyright of all artworks submitted to ArtsandHealth.ie remains with the Artist/Commissioner. artsandhealth.ie is granted a non-exclusive right in perpetuity to utilise submissions in whole or in part for artsandhealth.ie. Every effort will be made to reference the source of data. In the case of images, efforts will be made to reference project title and artist.
If you believe that any of your rights have been violated by material available on artsandhealth.ie, you may submit the details of your grievance in writing to artsandhealth.ie with the following information immediately:
- The nature of the complaint and an exact description of where the material about which you complain is located within the site
- Your electronic or physical signature
artsandhealth.ie retains sole discretion to publish submissions on its website and elsewhere in the media. Not all works/ item submitted to artsandhealth.ie will be published.
7. Third party sites and links
artsandhealth.ie does not endorse or accept any responsibility or liability for the content, services or information available on third party websites accessed via the site. If you decide to visit any linked site, you do so at your own risk. Any terms, conditions, warranties or representations associated with such dealings, are solely between you and the relevant provider of the service. artsandhealth.ie is not responsible for the data policies, content or security of these linked web sites.
Your submission to this site by default implies your agreement to indemnify and hold artsandhealth.ie, affiliates, officers, agents and employees free from and harmless from any claim or demand, including reasonable legal fees, made by any party due to or arising from your use of or posting upon this site or your violation of any rights of another.
Terms and Conditions of posting to the News and Events Section
artsandhealth.ie cannot accept responsibility for the opinions and information posted by others.
artsandhealth.ie and its affiliates reserve the right, but not the obligation, to monitor this section for inappropriate postings, and may when they deem necessary take editorial control of postings or comments.
In the event of inappropriate posting or use brought to the editorial panel’s attention, the editor(s) will endeavour remove posts of defamatory, libellous, vulgar, obscene, abusive, profane, threatening, hateful, racially, ethnically, or otherwise offensive or illegal nature and reserve the right to bar access to the site.
Postings may be examined, recorded, copied, censored, deleted, or used for authorised purposes. Use of the artsandhealth.ie website authorised or unauthorised, constitutes consent to such monitoring

- Do not post any information or other material protected by copyright without the permission of the copyright owner.
